Algemene voorwaarden prijsvraag/winactie
De Algemene voorwaarden winactie MOTOR actie ARUBA XMILE | Car wash 2024 (hierna ook te noemen: “Algemene voorwaarden, Algemene voorwaarden prijsvraag/winactie of Algemene voorwaarden winactie”) zijn van toepassing op de winactie en te vinden op de website  win.myguardiangroup.com. Door deelname aan de winactie gaat de deelnemer akkoord met de onderstaande Algemene voorwaarden winactie. Daarnaast wordt voor de winactie aanvullende voorwaarden (hierna ook te noemen: “aanvullende voorwaarden of aanvullende voorwaarden winactie )van toepassing verklaard. De winactie loopt van 12 tot 25 januari 2024. Na deze datum kunt u niet meer aan deze winactie deelnemen.

De winactie bestaat uit een gratis wekelijkse autowasbeurt gedurende drie maanden (12 wasbeurten) bij Albeiro Carwash (hierna ook te noemen: de “prijs”). De winnaar van deze actie heeft in de campagne periode van 12 tot 25 januari 2024 een autoverzekering afgesloten van Guardian Group Fatum. De bekendmaking van de winnaars vindt plaats vóór 30 januari 2024.

1. Iedereen mag één keer meedoen. 

2. De naam van de car wash is: Albeiro Carwash.

3. De aanbieder van de winactie is Guardian Group Fatum te Guardian Group Building, Lloyd G. Smith Blvd 162, Oranjestad, Aruba. Guardian Group Fatum is verantwoordelijk voor de winactie, de algemene voorwaarden en de aanvullende voorwaarden winactie zoals verwoord in deze Algemene voorwaarden en aanvullende voorwaarden winactie.

4. Uitsluitend natuurlijke personen vanaf 18 jaar aan de winactie deelnemen.

5. De deelnemer is verplicht tot het verschaffen van correcte, actuele en complete informatie bij de deelname aan de winactie. Guardian Group Fatum kan een winnaar verzoeken om voor uitreiking van de prijs bewijs te overleggen van zijn/haar identiteit en een geldige inschrijving op het door de deelnemer opgegeven woon-of verblijfadres. Guardian Group Fatum behoudt zich het recht voor de prijs te weigeren indien de opgegeven gegevens niet juist blijken te zijn of er onvoldoende kan worden aangetoond dat de opgegeven gegevens juist zijn.

6. Waarom houdt Guardian Group Fatum deze actie?:  Guardian Group wil iemand blij maken met 12x gratis autowassen. Voor de winnaar (een persoon die woonachtig is op Aruba).

7. De deelnemer geeft toestemming tot de verwerking van persoonsgegevens in verband met deelname aan de winactie. Guardian Group Fatum mag de persoonsgegevens uit de winactie opnemen in haar gegevensbestand, dat vertrouwelijk zal worden behandeld en uitsluitend gebruikt mag worden voor eigen marketing doeleinden en/of het updaten van de persoonsgegevens ten einde de dienstverlening aan haar klanten te verbeteren.

8. De persoonsgegevens van de winnaar(s) kunnen worden gebruikt om uitvoering te geven aan de winactie en de uitreiking van de prijs. In dat kader is Guardian Group Fatum gerechtigd om na digitale/schriftelijke toestemming de persoonsgegevens van de winnaar(s) te verstrekken aan de derde partijen die betrokken zijn bij de winactie. Deze zijn:  Albeiro Carwash.

9. De winnaars kunnen na interne loting bij Guardian Group Fatum per telefoon, e-mail of per post bericht ontvangen van de gewonnen prijs op het door de deelnemer opgegeven e-mailadres, correspondentieadres of telefoonnummer.

10. Over de uitslag en toekenning van de prijs kan niet worden gecorrespondeerd.

11. Deelname is uitsluitend bedoeld  voor personen die ingezetene zijn op Aruba. 

12. De prijs is persoonsgebonden en staat op naam van de winnaar. De prijs is niet overdraagbaar, niet restitueerbaar, inwisselbaar of uit te keren in geld of voor andere producten of diensten. Bij weigering of niet aanvaarding van de prijs of de aan de winactie verbonden voorwaarden als de Algemene voorwaarden winacties of de aanvullende voorwaarden winactie, zal de prijs niet aan de deelnemer worden uitgekeerd. Alsdan is Guardian Group Fatum gerechtigd een andere winnaar te trekken.

13. De afhandeling van de uitreiking van de prijs gebeurt door Guardian Group Fatum of een ander daartoe aangestelde partij. In het laatste geval is Guardian Group Fatum niet verantwoordelijk voor de levering van de prijs. In dat geval zal de datum van uitreiking van de prijs in overleg met de leverancier van de prijs worden bepaald.

14. Binnen enkele weken na interne loting, zal de gewonnen prijs in persoon aan de winnaar worden overhandigd.

15. De waarde van de winactie kan niet in geld of andere vorm worden uitgekeerd. Ook niet wanneer er om welke reden dan ook geen gebruik is gemaakt van de winactie. Guardian Group Fatum behoudt het recht om de winactie te annuleren wanneer er om welke reden dan ook daarvan geen gebruik meer kan worden gemaakt. 

16. Gebruik van de ter beschikking gestelde prijs is voor rekening en risico van de winnaar. Guardian Group Fatum kan niet aansprakelijk worden gesteld voor het gebruik of het niet-gebruiken van de prijs door de winnaar van de winactie.

17. Guardian Group Fatum verbindt zich slechts tot het vergoeden van de kosten van de Carwash (12 wasbeurten t.w.v. AWG 40,-). Guardian Group Fatum is niet verantwoordelijk noch aansprakelijk voor de verdere uitvoering van de winactie.

18. Guardian Group Fatum kan niet aansprakelijk worden gesteld indien de prijs niet wordt afgehaald door de winnaar of door een onbevoegd persoon in ontvangst is genomen, ook niet ingeval er geen notificatie of berichtgeving in enigerlei vorm door het post- of verzendbedrijf is achtergelaten.

19. Guardian Group Fatum is op geen enkele wijze aansprakelijk voor eventuele schade die voortvloeit uit de deelname aan de winactie noch voor eventuele stakingen, technische storingen, gebreken of vertragingen met betrekking tot de deelname aan de winactie of de aanwijzing van de winnaar.

20. Guardian Group Fatum is ook op geen enkele wijze aansprakelijk voor eventuele schade die voortvloeit uit faillissement, surseance van betaling of staking van (bedrijven van) derde partijen betrokken bij de uitvoering van de winactie.

21. Guardian Group Fatum is op geen enkele wijze aansprakelijk als de carwash niet voldoet aan de verwachtingen die u heeft, wanneer dit komt door uzelf of een derde die ingeschakeld is bij de uitvoering. U komt ook niet in aanmerking voor enige vorm van compensatie door Guardian Group Fatum.

22. Guardian Group Fatum is op geen enkele wijze aansprakelijk voor mogelijke problemen of gebreken die voortvloeien uit het gebruik van de website die betrekking heeft op de winactie.

23. Guardian Group Fatum is gerechtigd deelnemers te diskwalificeren en/of van deelname uit te sluiten als zij van mening is, dat de deelnemers niet conform de Algemene voorwaarden winactie handelen dan wel indien de deelnemers zich anderszins op frauduleuze wijze toegang verschaffen tot de winactie of het verloop van de winactie op oneerlijke wijze beïnvloeden.

24. Guardian Group Fatum is gerechtigd te allen tijde naar eigen inzicht en zonder voorafgaande kennisgeving deze Algemene voorwaarden en aanvullende voorwaarden gedurende de looptijd van de winactie te wijzigen of aan te passen, dan wel zonder opgave van reden de winactie te staken, te wijzigen of aan te passen vanwege haar moverende redenen, zonder dat Guardian Group Fatum daardoor op enigerlei wijze tot vergoeding van schade is gehouden jegens de deelnemer. Wijziging of aanpassing van de winactie, zal door Guardian Group Fatum op haar website op passende wijze publiekelijk bekend worden gemaakt.

25. Indien één of meer bepalingen van de Algemene voorwaarden en de aanvullende voorwaarden  winactie nietig of ongeldig zijn, dan tast dit niet de geldigheid van de overige bepalingen van de Algemene voorwaarden en aanvullende voorwaarden winactie aan.

26. Medewerkers van Guardian Group Fatum mogen niet meedoen met deze winactie.

27. De trekking van de winnaar wordt gedaan onder toezicht van het Marketing Team en de Chief Customer Officer. 

28. De prijzen moeten gelijk na de bekendmaking van de winnaar(s) in persoon  bij het hoofdkantoor van Guardian Group Fatum op Aruba worden afgehaald. Prijzen die niet gelijk zijn afgehaald, komen te vervallen. Bij het afhalen van de prijs dient de winnaar zich te identificeren met een geldige legitimatie.

29. Bij de overhandiging van de prijs mag Guardian Group Fatum desgewenst foto’s maken om deze vervolgens te gebruiken voor publicatie op de eigen website of via andere communicatie-uitingen. U kunt als winnaar aan de winactie geen verdere rechten hier aan ontlenen.

30. Guardian Group Fatum is niet aansprakelijk voor schades die voortvloeien uit vergissingen in enig drukwerk. Wijzigingen, type- en zetfouten zijn dan ook voorbehouden.

General Terms and Conditions Contest/Giveaway

 
The General Terms and Conditions Giveaway MOTOR ARUBA XMILE | Car Wash 2024 (hereinafter also referred to as "General Terms and Conditions," "General Terms and Conditions Contest/Giveaway," or "General Terms and Conditions Giveaway" apply to the giveaway and can be found on the website win.myguardiangroup.com. By participating in the giveaway, the participant agrees to the General Terms and Conditions Giveaway outlined below. In addition, additional conditions for the giveaway (hereinafter also referred to as "additional conditions" or "additional conditions giveaway" are declared applicable. The giveaway runs from January 12 to January 25, 2024. After this date, you can no longer participate in this giveaway.

The giveaway consists of a free weekly car wash for three months (12 car washes) at Albeiro Carwash (hereinafter also referred to as the "prize"). The winner of this giveaway has taken out a MotorGuard auto insurance from Guardian Group Fatum during the campaign period from January 12 to January 25, 2024. The announcement of the winners will take place before January 30, 2024.

 
1. Each person may participate only once.

2. The name of the car wash is: Albeiro Carwash.

3. The provider of the giveaway is Guardian Group Fatum at Guardian Group Building, Lloyd G. Smith Blvd 162, Oranjestad, Aruba. Guardian Group Fatum is responsible for the giveaway, the general terms and conditions, and the additional conditions of the giveaway as stated in these General Terms and Conditions and additional conditions of the giveaway.

4. Only natural persons aged 18 and above can participate in the giveaway.

5. The participant is obliged to provide correct, up-to-date, and complete information when participating in the giveaway. Guardian Group Fatum may request the winner to provide proof of identity and a valid registration at the participant's specified residential or mailing address before awarding the prize. Guardian Group Fatum reserves the right to refuse the prize if the provided details are incorrect or if it cannot be sufficiently demonstrated that the provided details are correct.

6. Why is Guardian Group Fatum doing this giveaway? Guardian Group wants to make someone happy with 12 free car washes. For the winner (a person residing in Aruba).

7. The participant gives consent to the processing of personal data related to participation in the giveaway. Guardian Group Fatum may include the participant's personal data from the giveaway in its database, which will be treated confidentially and may only be used for its marketing purposes and/or updating personal data to improve customer service.

8. The personal data of the winner may be used to implement the giveaway and award the prize. In this context, Guardian Group Fatum is authorized to provide the personal data of the winner to the third parties involved in the giveaway after digital/written consent. These are: Albeiro Carwash.

9. The winner may receive notification of the won prize by phone, email, or mail from Guardian Group Fatum after an internal draw, using the participant's provided email address, mailing address, or phone number.

10. There will be no correspondence about the result and allocation of the prize.

11. Participation is intended only for individuals who are residents of Aruba.

12. The prize is personal and is in the winner's name. The prize is not transferable, refundable, exchangeable, or payable in cash or for other products or services. If the prize or the conditions associated with the giveaway, such as the General Terms and Conditions of giveaways or additional conditions of the giveaway, are refused or not accepted, the prize will not be awarded to the participant. In that case, Guardian Group Fatum is entitled to draw another winner.

13. The handling of the awarding of the prize is done by Guardian Group Fatum or another appointed party. In the latter case, Guardian Group Fatum is not responsible for the delivery of the prize. In that case, the date of awarding the prize will be determined in consultation with the prize supplier.

14. Within a few weeks after the internal draw, the won prize will be personally handed over to the winner.

15. The value of the giveaway cannot be paid out in cash or any other form. Even if the giveaway is not used for any reason, Guardian Group Fatum reserves the right to cancel the giveaway if, for any reason, it can no longer be used.

16. The use of the provided prize is at the winner's expense and risk. Guardian Group Fatum cannot be held liable for the use or non-use of the prize by the winner of the giveaway.

17. Guardian Group Fatum only undertakes to reimburse the costs of the Carwash (12 car washes worth AWG 40,-). Guardian Group Fatum is not responsible or liable for the further execution of the giveaway.

18. Guardian Group Fatum cannot be held liable if the prize is not collected by the winner or is received by an unauthorized person, even if no notification or communication in any form by the postal or shipping company has been given.

19. Guardian Group Fatum is in no way liable for any damages arising from participation in the promotion, nor for any strikes, technical malfunctions, defects, or delays related to participation in the promotion or the designation of the winner.

20. Guardian Group Fatum is also in no way liable for any damages arising from bankruptcy, suspension of payments, or strikes of (companies of) third parties involved in the execution of the promotion.

21. Guardian Group Fatum is in no way liable if the car wash does not meet your expectations, whether due to yourself or a third party involved in the execution. You are also not eligible for any form of compensation from Guardian Group Fatum.

22. Guardian Group Fatum is in no way liable for potential problems or defects arising from the use of the website related to the promotion.

23. Guardian Group Fatum is authorized to disqualify participants and/or exclude them from participation if it believes that participants are not acting in accordance with the General Terms and Conditions of the promotion or if participants, in any other way, gain fraudulent access to the promotion or unfairly influence its course.

24. Guardian Group Fatum is entitled at any time, at its own discretion and without prior notice, to amend or adjust these General Terms and Conditions and additional conditions during the duration of the promotion or to cease, modify, or adjust the promotion for its own compelling reasons, without Guardian Group Fatum being obligated in any way to compensate damages to the participant. Changes or adjustments to the promotion will be publicly announced by Guardian Group Fatum on its website in an appropriate manner.

25. If one or more provisions of the General Terms and Conditions and additional conditions of the promotion are declared null or void, this does not affect the validity of the other provisions of the General Terms and Conditions and additional conditions of the promotion.

26. Employees of Guardian Group Fatum are not allowed to participate in this promotion.

27. The drawing of the winner is conducted under the supervision of the Marketing Team and the Chief Customer Officer.

28. The prizes must be collected in person at the main office of Guardian Group Fatum in Aruba immediately after the announcement of the winner(s). Prizes that are not collected immediately will expire. Upon collection of the prize, the winner must identify themselves with a valid identification.

29. During the presentation of the prize, Guardian Group Fatum may, if desired, take photos for subsequent use on its website or in other communication channels. As a winner of the promotion, you cannot derive any further rights from this.

30. Guardian Group Fatum is not liable for damages resulting from errors in any printed material. Changes, typographical errors, and errors in typesetting are reserved.
